I. Scope & Product Definition

This policy applies to all digital products provided by Itera Forge.

Itera Forge provides automated software services, not outcome-based consulting, representation, or advisory services.

By purchasing access, you acknowledge that you are purchasing:

  • Compute Powerprocessing resources used to generate outputs
  • Software Accessuse of automated drafting interfaces and tools

You are not purchasing a guaranteed result, approval, reinstatement, fund release, or platform decision.

II. Service Delivery & Consumption

The service is considered fully delivered and consumed at the moment a generation request is processed by our servers and an output is returned.

Service delivery is deemed complete regardless of whether the user chooses to read, download, edit, submit, or otherwise use the generated content.

III. Definitions

Case Session

A locked workspace for one platform and one issue type, storing inputs, drafts, and version history for a limited duration.

Generation

A generation occurs when the system processes a request and produces an output draft.

Each generation consumes compute resources.

Completed Generation

A generation that successfully returns readable output and passes system integrity checks.

IV. Refund Eligibility (Objective Criteria Only)

Refund eligibility is determined strictly by system-recorded logs and validation signals.

Eligible for Refund

Refunds or credit restoration may be issued only in the following cases:

  • Zero (0) generation credits were consumed
  • Server timeout or system error resulting in zero output
  • System crash blocking access to the session
  • Corrupted or unreadable export files (PDF/DOCX)
  • Material Technical Defect (defined below)

V. Material Technical Defect

A Material Technical Defect occurs only when, due to a verifiable system error, the generated output:

  • Is unintelligible or non-readable as natural language, or
  • Is completely unrelated to the user's confirmed platform and issue type selections

The existence of a Material Technical Defect is determined solely by internal system checks, sanity validations, and usage logs, not by subjective user assessment.

Explicit Exclusions

The following do not constitute a Material Technical Defect:

  • Generic or weak wording
  • Hallucinations or imperfect reasoning typical of AI systems
  • Dissatisfaction with strategy, logic, tone, or phrasing
  • Content that requires human editing or refinement

If the system functioned and produced output based on the user's inputs, the compute service is considered delivered.

VI. Non-Refundable Scenarios

Refunds are not issued for:

  • Platform rejection, suspension, limitation, or unfavorable outcomes
  • Subjective dissatisfaction with style, tone, or persuasiveness
  • Disagreement with generated strategy or structure
  • User errors, incorrect inputs, or wrong selections
  • Completed generations that passed system checks

AI-generated content is a tool output, not a human-authored guarantee.

VII. Courtesy Retry Policy

In limited cases, Itera Forge may offer a one-time Courtesy Retry, waiving the cost of an additional generation.

Important clarifications:

  • A courtesy retry is not a refund
  • It does not create entitlement or reset refund eligibility
  • Once used, the original transaction is considered fulfilled

Courtesy retries are discretionary and system-controlled.

VIII. Partial Refunds & Credit Rules

For purchases involving multiple paid credits:

  • Refunds apply only to unused paid credits
  • Used credits and bonus or promotional credits are non-refundable
  • All usage is recorded with immutable timestamps and logs

IX. EU / UK Right of Withdrawal Waiver

For users located in the EU or UK:

By clicking "Purchase" or "Generate", you acknowledge that you are purchasing digital content provided immediately.

Once the generation process has commenced, you explicitly waive your statutory right of withdrawal (cooling-off period) to the extent permitted by applicable consumer law.

X. External Disputes & Chargebacks

If a payment dispute or chargeback is initiated through a bank or card issuer:

  • The associated Case Session may be temporarily locked
  • Access may be restored only if the dispute is withdrawn or resolved
  • System usage logs may be provided to payment processors as evidence of service delivery

Decisions by payment providers override internal refund workflows.

XI. Limitation of Liability

To the maximum extent permitted by law, total liability arising from or related to the product is limited to the amount paid for the specific generation or Case Session giving rise to the claim.

XII. Policy Updates & Contact

This policy may be updated periodically.

The version effective at the time of purchase applies.
